Terms
Terms of use
These terms are a contract between you and Jason Feliz, operating sentientFi (“sentientFi,” “we,” “us”). They cover the sentientFi mobile app, the website at sentientfi.app, and the payment service behind them. The privacy policy is part of these terms.
If you do not agree, do not create an account, link an institution, or let sentientFi schedule a payment.
Who can use sentientFi
You must be at least 18 years old and able to form a contract. You must give a real email address and keep your login to yourself. You may not share the account or let someone else link their bank or card to it.
The service is offered from the United States. We do not claim it is available in every state or country.
What sentientFi is
sentientFi is software that watches credit-card utilization against a target you set and can pay a card down from a bank account you link, inside limits you set. sentientFi is not a bank, lender, broker, credit counselor, or credit repair organization. Stripe processes payments. We do not issue cards, hold deposits, or pull a credit report from a bureau.
We do not give financial, tax, legal, or credit advice. A utilization target, an interest estimate, or a score you type in is not a promise that your score, interest, or card rewards will change. Card rewards stay with the issuer. sentientFi does not change how you earn them.
Your account
You can sign up with email and a password, or with Apple or Google. You are responsible for activity under your login. Tell us at jason@sentientfi.app if you believe someone else is using the account.
You can delete the account in Settings. Deletion cancels open sentientFi payments, asks Plaid to disconnect each linked Item, and deletes the login and the financial rows we store for you. Stripe may still keep the customer record it created to move those payments. Details are in the privacy policy.
Linked accounts
Banks and cards are linked through Plaid. You authorize sentientFi and Plaid to collect the account data described in the privacy policy, including balances, transactions, and credit-card liability details. You represent that you are the owner of each account, or that the owner has authorized you to link it and to pay from it.
Plaid’s own terms and End User Privacy Policy also apply to that connection. We can stop using a link that Plaid or the institution marks as broken.
Payments
When you turn on a paydown, you authorize Stripe to debit the linked bank account and pay the linked card, in the amount the app shows, and only within the limits you set. Those limits include the amount you keep in checking, the maximum per payment, the maximum per day, and any approval you require for a larger payment. You can pause a card, skip a payment the app asks about, or pay manually.
A payment can fail or be blocked. Causes include your limits, a low bank balance, a disconnected bank or card, a decline by the bank, card issuer, or Stripe, or Plaid data that is missing or stale. sentientFi does not guarantee that a payment will post before a due date or statement close, or that interest or fees will be avoided.
Payment amounts and the decision to schedule one come from the sentientFi engine. The in-app assistant explains past activity. It cannot start, change, or cancel a payment.
There is no subscription fee during this beta. If we charge a fee later, we will update these terms and tell you by email before it applies. Bank, card, and Stripe fees charged by those companies are not sentientFi fees.
Beta
The product is in early access. Features, limits, and copy can change. The app may show sandbox mode while live payments are off. A sandbox payment does not move money at your bank.
Acceptable use
You will not:
- Break the law, or use sentientFi to move money you are not allowed to move.
- Link an account you are not authorized to use.
- Probe, scrape, or disrupt the app, the website, or the API.
- Reverse engineer the service except where the law forbids that limit.
- Misrepresent your identity.
Our intellectual property
The app, website, brand, and software belong to sentientFi. These terms do not give you any ownership in them. You keep ownership of the information you provide. You give us permission to use it only to run the service, as the privacy policy describes.
Stopping the service
You can stop using sentientFi and delete the account at any time. We can suspend or close an account if we reasonably believe it is required by law, a security incident, fraud, abuse, or a breach of these terms. When we can, we will email the address on the account and explain how to reach us.
Disclaimers
The service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the service will be uninterrupted, accurate, or error-free. Institutions, Plaid, and Stripe can change or break a connection without notice from us.
Limits on liability
To the fullest extent the law allows, sentientFi is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, card interest, issuer fees, lost rewards, or a credit-score change, even if we were told those losses were possible.
Our total liability for any claim arising out of the service is limited to the fees you paid sentientFi in the three months before the claim. If you paid no fees, that cap is zero. Some places do not allow these limits. Where that is the law, the limit applies only as far as it is allowed. Nothing in these terms limits liability for fraud or for a harm the law does not allow us to limit.
Your responsibility for claims
You will defend and hold harmless sentientFi and Jason Feliz against claims, losses, and reasonable legal costs that arise from your breach of these terms, your lack of authority over a linked account, or your misuse of the service. We will tell you about the claim. You will not settle it in a way that admits fault by us without our agreement.
Disputes
These terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts in California are the venue, except that you may bring an individual claim in small-claims court. We do not require arbitration.
Before filing a lawsuit, email jason@sentientfi.app and give us 30 days to try to resolve the dispute. Either of us may seek an injunction for misuse of the service or for a security incident without waiting those 30 days.
Apple
If you downloaded sentientFi from the Apple App Store or TestFlight, these terms are between you and Jason Feliz, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price if any. Apple has no other warranty obligation. Apple is not responsible for product-liability, consumer, or intellectual-property claims about the app. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.
Other terms
If a court holds one part of these terms unenforceable, the rest stays in effect. A delay in enforcing a right is not a waiver. You may not assign these terms. We may assign them if the service is transferred, and we will email the address on the account if that happens. These terms, together with the privacy policy, are the whole agreement about the service.
Changes
We will change the effective date on this page when the terms change. For a material change, we will also email the address on the account before the change applies, when we have that address. Using the service after the effective date means you accept the updated terms. If you do not accept them, delete the account before that date.
